| |
Here the 'the company' means
HERITAGE NORTH EAST PRIVATE LTD. and the client means the person or
persons in whose name and/or on whose behalf the booking is made.

1. There is no contract
between the Company and the client until the Company has confirmed
its acceptance in writing on receipt of the appropriate deposit. An
account will be sent with the confirmation and should be settled at
least four weeks before the commencement of the tour. If not paid
in that time the Company reserves the right to cancel the booking
with consequent loss of deposit and apply the scale of cancellation
charges as shown. |

2. The Company has the right at any time and for any reason:
(1) to cancel the contract prior to the date of commencement of
the tour; and if it does so its liability shall be limited to refunding
all monies including the initial deposit paid by the client, and/or
(2) to amend alter vary or withdraw any tour programme or facility
it has advertised or published or to substitute a hotel of similar
class if it is deemed advisable or necessary. In either case the
Company shall not be liable for any damage, additional expense or
consequential loss suffered by the client.

3. No person other
than the Company in writing has the authority to vary, add, amplify
or waive any description, term or condition set forth herein. |

4. . In the event
of the Company exercising its rights to amend or alter any tour plan
advertised in their brochure after such tour has been booked the client
shall have the right:
(1) to continue with the tour as amended or altered;
(2) to accept any alternative tour which the Company may offer.
In neither of these above cases shall the Company be liable to the
client for any damage, additional expense or consequential loss suffered
by him. |

5. The Company shall
in no circumstances whatsoever is liable to the client or any person
traveling with him for:
(1)any death, personal injury, sickness, accident, loss, delay, increased
expense, consequential loss or any misadventure howsoever caused;
(2)any act, omission,default of any hotelier, carrier or other person
or by any servant or agent employed by them who may be engaged or
concerned in the provision of accommodation, refreshment, carriage
facility or service for the client or for any person travelling with
him howsoever caused;
(3) the temporary or permanent loss of or damage to baggage or personal
effects howsoever caused.
In this condition the expression 'howsoever caused' includes negligence
on the part of any person. |

6. No liability on
the part of the Company arising in any way out of this contract in
respect of any tour facility shall exceed the total amount paid or
agreed to be paid for the tour, and shall in no case include any consequential
loss or additional expense whatsoever. |

7. Any claim or complaint
by the client must be notified to the Company in writing and must
reach Company within 28 days of his return from holiday. No claim
notified to the Company outside this period will be entertained and
the Company shall incur no liability whatsoever in respect thereof. |

8. In entering into
the contract the Company, in addition to acting for itself is and
shall be deemed to be acting as agent and trustee of its servants
agents and contractors and as agent and trustee of all operators and
their servants ,agents and contractors, who at any time directly or
indirectly take parting the effectuation of the tour. All such persons
and companies shall to this extent be or be deemed to be parties to
the contract and shall be entitled to the benefit of the same immunities
and exemptions from liability as are available to the Company under
these conditions. |

9. Each of these
conditions shall be severable from the other and if any provision
be invalid, illegal or unenforceable the remaining provisions shall
nevertheless have full force and effect. |

10. Any or all disputes,
controversies and differences relating to this contract or any breach
thereof shall come under the jurisdiction of Guwahati High Court.

Tour
Prices |

The prices quoted in the
brochures or leaflets published by the Company are in Indian Rupees.
The Company reserves the right to amend the prices if affected by
circumstances beyond its control and if change in fuel cost occurs
before the date of departure and to increase prices accordingly. Any
increase in price must be paid for before departure.
Cancellations
You have the right at any time to cancel the bookings but if you do
so you must make the cancellation in writing, and the following terms
will apply: |

If
you change. your booking
A handling fee of Rupees 1500 per transaction will be charged for
any alteration or amendment made to a booking after the booking has
been confirmed to and accepted by our clients.
Please note : If you change your date of tour within 7 days of commencement
this will be treated as a cancellation and rebooking. The relevant
charges will apply. |

Passports
and Visas |
| |
All foreign nationals opting
for this tour should have a valid passport for the duration of the
tour. Also the foreign nationals are responsible for getting their
own visas and must ensure that they can obtain these visas before
entering into a booking commitment with us. Long delays in obtaining
visas sometimes occur: be sure to apply well in advance of the anticipated
date of journey.
